2. Scope

2.1

These general terms and conditions (GTC) apply to participation on every booked seminar on shop.bujinkannintoku.at and the associated ticket sales, organized by the above organizer. Deviating terms and conditions of the participants are not valid.

2.2

The organizer reserves the right to make changes and additions to these regulations. Possible changes and additions become valid through publication on the event website shop.bujinkannintoku.at.

3. Registration and conclusion of contract

3.1

Registration for participation in the offered event is only possible via this website shop.bujinkannintoku.at.

3.2

The organizer submits an offer for the conclusion of a purchase contract with the information provided on the website. The participant accepts his offer to conclude a purchase contract by completing the ordering process, filling out all required fields of the order mask, accepting these GTC and clicking on the “Confirm registration” button in the last order mask.

3.3

The prerequisite for the conclusion of the contract is that the participant is at least 18 years old or, in the case of minors, acts with the permission/approval of his legal representative/guardian.

3.4

The contract for participation in the events is only concluded after the organizer has confirmed the registration to the participant in writing via e-mail (payment received). Changes and/or additions to the contract must be made in writing. This also applies to the cancellation of the written form clause.

4. Payment

4.1

Payment is made exclusively via the payment methods specified on the website. All prices are due within 14 days upon conclusion of the contract.

4.2

If the participant does not pay within 14 days after receipt of the order confirmation, the organizer can withdraw from the contract. If the organizer withdraws from the contract, the participant loses his right to participate in the event. The participant bears any fees incurred as a result of the transfer.

4.3

If a payment is charged back (e.g. due to insufficient funds in the account specified when ordering), the participant must compensate for any damage or expenses incurred as a result of the chargeback. These include, in particular, the bank charges and a processing fee of EUR 10.00 per return debit for processing by the organizer. In the event of an unjustified chargeback (reversal) of the credit card, processing costs of EUR 20.00 will be charged. In the event of a chargeback, the organizer is entitled to withdraw from the contract immediately. The participant thus loses his right to participate in the booked event. Further claims of the organizer against the participants are not affected by this.

5. Right of Withdrawal

5.1 Cancellation policy

Right of cancellation: If the participant is a consumer he can cancel his contractual declaration within 14 days in text form (e.g. letter, e-mail) without giving reasons. You can do this by sending an e-mail, stating the order ID. The participants use the following contact details for this purpose:

The period begins after receipt of this instruction in text form, but not before the conclusion of the contract and not before the organizer has fulfilled the information obligations. Sending the cancellation in good time is sufficient to meet the cancellation deadline.

Consequences of revocation: In the event of an effective revocation, the services received by both parties must be returned and any benefits (e.g. interest) surrendered. If the participant cannot return or hand over the received service and use (e.g. advantages of use) or only partially or only in a deteriorated condition, he has to pay compensation to the organizer in this respect. Obligation to refund payments must be fulfilled within 30 days. The period begins for the participant when the declaration of revocation is sent and for the organizer when it is received.

5.2

The right of withdrawal expires prematurely if the organizer begins to provide the service with the express consent of the participants before the end of the withdrawal period or if the participants arrange for the service to be provided themselves.

6. Withdrawal/Cancellation

6.1

If the participant does not wish to take part in the event, he must declare his withdrawal from the contract to the organizer in writing or by e-mail.

a) In the event of withdrawal/cancellation 1 month before the booked event, the participation fee will be reimbursed. There will be no reimbursement for ordered merchandise or booked evening events.

b) In case of withdrawal/cancellation after 2 weeks before the booked event, only 50% of the participation fee will be reimbursed. There will be no reimbursement for ordered merchandise or booked evening events.

c) In the event of withdrawal/cancellation within less than 2 weeks before the booked event, no refund will be made.

6.2

If the registered participant is unable to attend the event, the participant has until 2 weeks before the seminar to nominate a substitute person for participation in writing or by email.

7. Services

7.1

The scope of the contractual service within the framework of the event results from the information on the event website and, if applicable, from the existing registration forms and the confirmation of participation from the organizer. In the event of contradictions and in any case, the service description in the booking confirmation is decisive.

7.2

If services are not provided in accordance with the contract, the participant is entitled to remedy. Defects must be reported immediately. Claims for reimbursement of the participation fee due to services that were obviously not provided in accordance with the contract must be asserted within 14 days of the end of the event.

7.3

The organizer reserves the right to appoint a substitute speaker in exceptional cases. The participant will be informed in good time about the respective changes.

7.4

Travel, accommodation and meals are not included in the event offer, unless services of this type are expressly listed in the event description. If a contractual partner does not make full or partial use of properly offered services, there is no entitlement to a refund of the participation fee.

8. Admission and admission control

8.1

Access to the event is only possible with a valid booking. At the first entrance the participant has to check-in with his / her name before being able to participate in training.

8.2

Upon entry to the event, a security check may be carried out by the on-site security staff.

8.3

The organizer reserves the right to refuse entry to the event if a visitor is carrying prohibited objects, is under the influence of alcohol, is under the influence of drugs or is openly opposed to the free democratic basic order within the meaning of the Basic Law. If there is an important reason for the refusal of admission, the admission ticket loses its validity and the admission price will not be refunded.

9. Prohibited Items

9.1

Weapons of all kinds (except blunt training weapons), pyrotechnic objects, drugs, shirts or patches with an obvious political background, film and video cameras or other recording devices that are obviously not only for private use due to their equipment, type and size are to be found throughout the event , forbidden.

10. Protection against infection

In addition to the legal requirements, the organizer expressly reserves the right to carry out additional measures to protect against infection. Failure to comply with the measures will result in exclusion from the event.

11. Event Cancellation

11.1

For urgent reasons, the organizer can cancel the event with a reasonable period of notice. This also applies to the evening programs.

11.2

In the event of cancellation of the event, the organizer will refund the payment made in full within 14 days. Any additional costs incurred by the participant will not be reimbursed.

12. Copyright and Other Rights

Private photo and video recordings during the training sessions are expressly not permitted at the request of the instructor. Violations can lead to exclusion from the event at the discretion of the organizer. During the breaks and at the evening events, private video and photo recordings are permitted. The organizer rejects any liability, the respective photographer is responsible for compliance with the GDPR.

13. Photo and video recording

The participants in the event irrevocably and free of charge agree that the organizer is entitled to create, reproduce, send or have sent photo and video recordings of himself that go beyond the reproduction of an event of current affairs, as well as in audiovisual media to use.

14. Liability

14.1

The organizer or his vicarious agents are only liable in the event of intent or gross negligence.

14.2

The liability of the organizer for initial impossibility and for the breach of essential contractual obligations remains unaffected by the above limitation of liability, even in the case of simple negligence, but limited to the foreseeable and contract-typical damage. Claims for damages resulting from injury to life, limb or health as well as under the Product Liability Act remain unaffected by the above limitation.

14.3

The organizer is not liable for lost or damaged items.

14.4

The organizer is not liable for disruptions of any kind caused by circumstances beyond their control.

14.5

Liability for damage incurred on arrival and departure from the venues, as well as for losses and accidents, is excluded. Parking in designated parking spaces is at your own risk.

14.6

With his registration, the participant declares that in the event of injuries (even with long-term consequences) he cannot claim any compensation or the like from the organizer, the speakers, trainers and others. Everyone is responsible for their own accident protection.
